Terms of Booking
Important Legal Notice: These Terms of Booking contain important limitations of liability, assumption of risk, release, cancellation, removal, and other legal terms that affect your rights. Please read them carefully before booking, attending, or participating.
Floating Futsal Pitch Location: The Floating Futsal Pitch is located at Harbourfront Centre, 235 Queens Quay W, Toronto, ON M5J 2G8. The Floating Futsal Pitch is located along the boardwalk in Lake Ontario. Follow the laneway from Queens Quay W to access the Floating Futsal Pitch.
Jumpstart Community Pitch Location: The Jumpstart Community Pitch is located at Harbourfront Centre, 235 Queens Quay W, Toronto, ON M5J 2G8.
Eligibility: Participation is open only to persons who meet Sport Chek's eligibility, safety, conduct, supervision, and waiver requirements, as determined by Sport Chek in its sole discretion. Participants under the age of majority in their province or territory of residence may only attend or participate if accompanied or supervised as required by Sport Chek and if a parent or legal guardian has completed and accepted the required waiver and any other required consents on their behalf before participation. Sport Chek reserves the right to refuse registration, entry, attendance, or participation at any time where eligibility, identity, age, supervision, conduct, health, safety, capacity, or waiver requirements are not satisfied.
Waiver Requirement: Participation is conditional upon completion, acceptance, and submission of Sport Chek's applicable participation waiver, release, assumption of risk, and any required consent forms, each in the form required by Sport Chek from time to time. Participants under the age of majority must have the waiver completed by a parent or legal guardian on their behalf. The waiver has legal consequences and may limit or exclude rights to make claims against Sport Chek and other released parties. Participants who do not complete the required waiver and consents to Sport Chek's satisfaction will not be permitted to participate.
Assumption of Risk: Participation in futsal, soccer, skills competitions, tournaments, and related activities involves inherent and other risks, including the risk of personal injury, illness, death, property damage, slips, falls, collisions with other participants or objects, unsafe or changing surface or weather conditions, equipment failure, and the acts or omissions of other participants. By attending or participating, each participant voluntarily assumes all risks associated with attendance at and participation in the event and agrees to participate only within their abilities and in accordance with all posted rules and staff instructions.
Health and Fitness: Each participant is responsible for determining whether they are physically fit and able to safely participate. Participants should not participate if they are injured, unwell, under the influence of alcohol or drugs, or otherwise unable to participate safely. Sport Chek may refuse or discontinue participation for any person who appears unable to participate safely or who poses a risk to themselves or others.
Capacity Limits: The Floating Futsal Pitch has a maximum on-pitch capacity of 14 players at one time, or such lower limit as Sport Chek or on-site staff may require for safety, operational, or programming reasons. Sport Chek may restrict access to the playing area, sidelines, viewing areas, and substitution areas at any time. Teams or groups exceeding applicable capacity limits must rotate players and attendees in accordance with staff instructions. Sport Chek may deny entry or participation to any excess participant or attendee without refund, extension, or compensation.
Arrival Time: Booked sessions are scheduled for fixed time slots and will begin and end as scheduled, subject to these Terms of Booking. Participants are responsible for arriving early enough to check in, complete any required waiver or consent process, and be ready to participate at the scheduled start time. Tournament play is scheduled for 12PM - 2PM ET unless otherwise communicated by Sport Chek. A late arrival may result in reduced play time, adjustment of match format, or forfeiture of all or part of the booking, in each case without refund, extension, credit, or other compensation. A grace period, if offered, is provided solely as a courtesy and does not create any obligation on Sport Chek to delay programming or extend the booking.
Tournament Duration: Each Tournament will host four teams of five players competing in a knockout bracket format. Each game consists of two 4.5-minute halves (9 minutes total), and each Tournament will take approximately two hours to complete.
Weather: The Floating Futsal Pitch and, where applicable, the Jumpstart Community Pitch may be delayed, suspended, shortened, rescheduled, relocated, or cancelled due to inclement weather, water, site, surface, visibility, equipment, operational, safety, or other conditions that Sport Chek or on-site staff determine, in their sole discretion, may affect safe or practical operation. If this occurs, Sport Chek will use reasonable efforts to notify the booking contact using the contact details provided at registration. Any rebooking, substitute programming, credit, or other accommodation will be offered, if at all, in Sport Chek's discretion and subject to availability. Sport Chek is not responsible for travel, accommodation, incidental, or other out-of-pocket costs arising from any such change, suspension, or cancellation.
Safety First: Sport Chek reserves the right, in its sole discretion, to inspect the pitch and surrounding area, establish and enforce safety rules, restrict access, require participants to stop play, remove participants, modify match format, staffing, or programming, and delay, suspend, or cancel any booking or activity where conditions are considered unsafe or unsuitable, including but no limited to due to weather, equipment issues, overcrowding, emergency response requirements, or participant conduct.
Required Footwear & Gear: Participants are solely responsible for wearing and using appropriate footwear, clothing, and personal gear for the applicable activity, surface, and weather conditions. The Floating Futsal Pitch requires rubber-soled footwear and cleats are not permitted. Cleats may be permitted on the Jumpstart Community Pitch only where authorized by Sport Chek or on-site staff. Sport Chek may prohibit any footwear, apparel, or equipment it considers unsafe, unsuitable, damaging to the surface, or otherwise inappropriate. Any balls or other equipment provided by Sport Chek are used at the participant's own risk and may be withdrawn, substituted, or limited at any time.
Staff Directions and Rules: All participants and attendees must immediately follow the directions of Sport Chek personnel, venue personnel, referees, facilitators, security, and other authorized representatives. Sport Chek may adopt, post, revise, and enforce additional event, venue, gameplay, spectator, access, safety, and equipment rules at any time, and all such rules form part of these Terms of Booking.
Code of Conduct: Participants and attendees must comply with these Terms of Booking, all posted rules, applicable laws, venue requirements, and all staff instructions, and must behave in a respectful and sportsmanlike manner. Without limiting any other rights or remedies, Sport Chek may refuse entry, deny participation, require a person to leave, remove any participant or attendee, suspend or terminate play, shorten or cancel a booking, disqualify a team, or involve venue staff, security, or law enforcement where a person engages in unsafe, disruptive, abusive, threatening, unlawful, intoxicated, disorderly, or inappropriate behaviour, damages property, fails to follow instructions, or otherwise creates a risk to safety, operations, property, or the experience of others. In such cases, no refund, rebooking, extension, credit, or compensation will be provided.
Photography & Filming: The event may be photographed, filmed or otherwise recorded by or on behalf of Sport Chek, Harbourfront Centre, media partners, or other authorized parties. By participating, you acknowledge that images or recordings may be used by Sport Chek for promotional or informational purposes, subject to the terms of the participation waiver. Participants who do not wish to be recorded should not participate unless Sport Chek.
Booking Use: Bookings are personal, revocable, non-transferable, and may not be resold, assigned, sublicensed, or used for unauthorized commercial, promotional, or group activity purposes without Sport Chek's prior written approval. Sport Chek may cancel any booking made or used in breach of these Terms of Booking.
Changes: Sport Chek may update these Terms of Booking from time to time. The version in effect at the time of booking or participation, as applicable, will govern, unless Sport Chek is required to make a change immediately for legal, safety, security, or operational reasons. Sport Chek may also modify programming, match formats, staffing, hours, access procedures, or operational requirements at any time.
Personal Property: Participants and attendees are solely responsible for their clothing, footwear, equipment, valuables, and other personal property brought to the venue. Sport Chek is not responsible for any lost, stolen, or damaged personal property except to the extent such liability cannot legally be excluded.
Damage to Property: Participants and attendees are responsible for any loss, damage, or excessive cleaning costs arising from their acts or omissions, including damage to the pitch, venue, equipment, fixtures, or other property of Sport Chek, Harbourfront Centre, or any third party. Sport Chek reserves the right to pursue recovery of all resulting costs and losses to the fullest extent permitted by law.
No Guarantee of Uninterrupted Use: Sport Chek does not guarantee uninterrupted access to the pitch, completion of any session, tournament, or match schedule, or the availability of any particular amenity, staff member, or feature. Delays, interruptions, closures, or modifications may occur at any time for safety, operational, maintenance, site, or other reasons.
Governing Law; Severability: These Terms of Booking are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. If any provision of these Terms of Booking is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect to the fullest extent permitted by law.
